Acceptance of terms
These Terms of Service (“Terms”) govern Your use of the services, software and websites (the “Service”) provided by Docstream AS (Docstream), a Norwegian corporation (registration number NO 983526101).
The Service is a web app called “Readin” (readin.no).
Please read these Terms carefully before using the Service. If you do not agree to these Terms, you shall immediately stop using the Service.
Acceptable use of the Service
All users of the Readin Service shall comply with this Acceptable Use Policy. Failure to do so may result in suspension or termination of Your Account. If You have agreed to Docstream’s Terms of Service on behalf of Your organization, then this Acceptable Use Policy will apply to all users of the Service under Your Account (the “End Users”).
You may only use the Readin’s Service as it is intended to be used.
The Service offers publishing of your written content. You are solely responsible for the content you publish using the Service, and must have the required rights to publish all the Content, including, but not limited to, text, graphics, pictures, data, videos and equations.
You may not post any Content on the Service that:
- may create a risk of harm, loss, or physical or mental injury to any other person or the risk of loss or damage to any property.
- violates any applicable law, any intellectual property rights, or anyone’s right of privacy or publicity.
- is defamatory, libelous, threatening or that constitutes hate speech.
- contains any information that You do not have a right to make available under law or any contractual or fiduciary duty.
You shall not use the Service in a way that violates any laws, infringes on anyone’s rights, is offensive, or interferes with the Service or any features on the Service. You shall ensure that all End Users respect this agreement. You are responsible for any and all activities that occur under End User’s account.
Docstream reserves the right to remove and delete any information or materials if Docstream reasonably suspects it to be comprised by the prohibition above.
You shall ensure that End User identities, passwords, and equivalent obtained by You in conjunction with registration are stored and used in a secure manner and cannot be accessed and used by third parties. You shall notify Docstream immediately of any unauthorized use or any other breach of security.
Invoicing and payment
The Service’s subscription fee is charged monthly or annually. Any charge is incurred when subscribing according to the current and updated price list for the relevant subscription, before VAT. All payments are non-refundable.
Docstream has the right to without notice delete your published content if there is no active paid Subscription for the Service.
If You choose to cancel the Subscription during the Subscription Term, you may use the Service until the end of your current Subscription Term. There will not be issued a refund for any charged fees.
Docstream reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) without any personal notice. Docstream shall not be liable to You or to any third party for any modification, suspension or discontinuation of the Service.
Any new features that augment or enhance the Service, including the release of new tools and resources, shall be subject to these Terms of Service. Continued use of the Service after any such changes shall constitute Your agreement to such changes.
Docstream may revise these Terms from time to time without notice or acceptance by You.
Intellectual property rights
Docstream claims no intellectual property rights to the Content You provide on the Service. Content and Profile(s) uploaded will be Your proprietary right.
You are granted a limited, revocable, non-exclusive and non-transferable right to use the Service in accordance with this agreement solely for Your own internal business purposes.
You have no right to sell, lend, sub-license, distribute in any way, create derivative works of, copy, frame, access or try to get access to the source code of, mirror or reverse engineer any part or feature of the Service, including all underlying intellectual property rights and/or knowhow. Furthermore, You may not in any way modify, decompile, disassemble or reverse engineer the Service. The list is non-exhaustive.
You understand that Docstream uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run the Service.
Warranty disclaimer and limitation of liability
The service is provided “as-is” without warranties of any kind. You expressly acknowledge and agree that the use of the Service is at Your own risk, and thus that the entire risk as to quality, performance, accuracy and result of the use is with You. There are no other warranties, representations, conditions or guarantees of any kind whatsoever, either expressed or implied by law (in contract or tort) or custom, including, but not limited to those regarding merchantability, fitness for purpose or non-infringement. Without limiting the above, Docstream does not warrant that the Service will meet Your requirements or that the operation or result of the Service will be free from interruptions or errors.
In no event will Docstream be liable for any damage, be it direct or indirect, incidental or consequential, in connection with or arising out of the use of the Service or for any harm to websites, applications, systems or environments, loss or corruption of data, or any other damage caused as a consequence from the use of the Service.
You agree to indemnify, defend and hold harmless Docstream, its affiliates, officers, directors, employees, consultants and suppliers from any and all third party claims, liability, damages and/or costs (including, but not limited to, attorney fees as and when incurred) arising from Your use of the Service, Your use of Your Account, Your violation of these Terms of Service or the infringement or violation by You or any other user of Your Account, or user leaving information at Your projects, of any intellectual property relating to the service (including without limitation Your Content) or other right of any person or entity.
This Agreement shall be governed by and construed under the laws of Norway. Any dispute arising out of or relating to this Agreement which has not been settled amicably by the Parties will be exclusively resolved by Oslo District Court.
